Overview

Welcome to Pawd. The terms "we", "us" and "our" refer to Pawd Store (ABN 73 023 080 244), which trades as Pawd. Pawd operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a shopping experience (the "Services"). Pawd is powered by Shopify, which enables us to provide the Services to you.

The terms below, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or the Privacy Policy, you should not use or access our Services.

Section 1 - Access and account

By agreeing to these Terms, you represent that you are at least the age of majority in your state or territory of residence, and that you have given your consent for any of your minor dependants to use the Services on devices you own, purchase or manage.

To use the Services, including browsing our store or buying any of the products we offer, you may be asked to provide certain information, such as your email address and your billing, payment and shipping details. You represent and warrant that all the information you provide is correct, current and complete, and that you have all rights necessary to provide it.

You are solely responsible for keeping your account credentials secure and for all activity on your account. You may not transfer, sell, assign or license your account to any other person.

Section 2 - Our products

We have made every effort to describe and show our products accurately. Colours and product appearance may still differ slightly from how they appear on your screen, depending on the device you use and its settings.

Product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time and may limit the quantities of any product that we offer to any person, region or jurisdiction, on a case-by-case basis.

Section 3 - Orders

When you place an order, you are making an offer to buy. Pawd may accept or decline your order at its discretion, and your order is not accepted until we confirm acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting it, as we may not be able to cancel an order once it has been accepted. If we do not accept, change or cancel an order, we will contact you using the email address, billing address or phone number provided with the order.

All returns, exchanges and refunds are subject to our Refund Policy, which forms part of these Terms.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale.

Section 4 - Prices and billing

Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect when the order is placed, as set out in your order confirmation email. Prices are shown and charged in the currency of your market. Shipping is shown at checkout before you pay.

From time to time we may offer promotions with their own terms. If the terms of a promotion conflict with these Terms, the promotion terms apply.

You agree to provide current, complete and accurate purchase, payment and account information for every purchase, and to keep it up to date so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the payment information you provide is true, correct and complete, (ii) you are authorised to use that payment method, (iii) charges you incur will be honoured by your card issuer or payment provider, and (iv) you will pay the charges you incur at the posted prices, including shipping and any applicable taxes.

Section 5 - Shipping and delivery

We ship to Australia, New Zealand, the United States, the United Kingdom and the 27 countries of the European Union. Delivery times are estimates, not guarantees, and are set out on our Shipping Policy. We are not responsible for delays caused by carriers, customs processing or events outside our control.

For orders delivered outside Australia, you are the importer of record and are responsible for any duties, taxes and import fees charged by customs or the carrier. If a parcel is refused, returned or abandoned because these charges were not paid, any refund will be handled under our Refund Policy and applicable law, less any shipping costs we cannot recover.

Section 6 - Intellectual property

Our Services, including trademarks, text, graphics, images and the design, selection and arrangement of the content, are owned by Pawd, its affiliates or its licensors and are protected by Australian and international intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, publicly display, republish, download, store or transmit any material on the Services without our prior written consent, except as these Terms allow. Nothing in these Terms grants you a licence or other rights under any intellectual property of Pawd, Shopify or any third party.

Shopify's name, logo and product names are trademarks of Shopify. All other names, logos and product names on the Services are the trademarks of their respective owners.

Section 7 - Optional tools

We may give you access to third-party tools as part of the Services, which we do not monitor or control. We provide access to such tools "as is" and "as available", without warranties or endorsement, and we have no liability arising from your use of them. Any use of optional tools is at your own risk and subject to the terms of the relevant provider.

New features we add to the Services in future are also subject to these Terms.

Section 8 - Third-party links

The Services may contain links to websites run by third parties. We are not responsible for the content or accuracy of third-party websites, and you visit them at your own risk. Please review a third party's policies before you transact with them. Questions about third-party products and services should be directed to that third party.

Section 9 - Relationship with Shopify

Pawd is powered by Shopify, but any sales and purchases you make in our store are made directly with Pawd. Shopify is not responsible for any aspect of a sale between you and Pawd, including any injury, damage or loss resulting from products you buy, and you release Shopify and its affiliates from claims arising from your purchases from Pawd.

Section 10 - Privacy policy

All personal information we collect through the Services is subject to our Privacy Policy, and certain personal information may also be subject to Shopify's privacy policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be shared with Shopify and with third parties located outside the country where you live, in order to provide the Services to you.

Section 11 - Feedback

If you send us ideas, suggestions, reviews or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free licence to use, reproduce, modify, publish and display that Feedback in any medium for any purpose, including commercial use. You confirm that you own or have the rights to your Feedback, that it is accurate, and that it does not infringe anyone's rights or contain anything unlawful, abusive or harmful. We are under no obligation to keep Feedback confidential, to pay for it or to respond to it, and we may remove Feedback at our discretion.

Section 12 - Errors, inaccuracies and omissions

Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, delivery times or availability. We reserve the right to correct them, and to change information or cancel orders if information is inaccurate, at any time without prior notice, including after you have submitted your order. If we cancel an order for this reason, we will refund any payment you have made for it.

Section 13 - Prohibited uses

You may use the Services for lawful purposes only. You must not use the Services to break any law, infringe intellectual property rights, harass or harm any person, transmit false or misleading information, send spam, impersonate any person or entity, upload malicious code, collect other people's personal information, scrape the Services, or interfere with their security or operation. We may suspend or terminate your account at any time if you breach these Terms.

Section 14 - Termination

We may end these Terms or your access to the Services at any time without notice, and you remain liable for all amounts due up to the date of termination. The sections on intellectual property, feedback, termination, disclaimers, limitation of liability, indemnification, severability, waiver and entire agreement, assignment, governing law and privacy continue to apply after termination.

Section 15 - Australian Consumer Law

Our products come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded. Sections 16 and 17 apply only to the extent the law allows.

Section 16 - Disclaimer of warranties

The information on the Services is provided for general information only. We do not warrant its accuracy, completeness or usefulness, and any reliance you place on it is at your own risk.

Except as expressly stated by Pawd and subject to Section 15, the Services and all products offered through them are provided "as is" and "as available", without warranties or conditions of any kind, express or implied. We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error-free.

Section 17 - Limitation of liability

Subject to Section 15 and to the fullest extent permitted by law, Pawd, its partners, officers, employees, agents, contractors, service providers and licensors, and Shopify and its affiliates, are not liable for any indirect, incidental, special or consequential loss or damage, including lost profits, revenue, savings or data, arising from your use of the Services or any product bought through them. Where our liability for a breach of a consumer guarantee cannot be excluded but can be limited, it is limited, at our option, to replacing or repairing the goods, supplying equivalent goods, or paying the cost of doing so.

Section 18 - Indemnification

You agree to indemnify Pawd, Shopify and their affiliates, officers, employees, agents, contractors, licensors and service providers against any losses, damages, liabilities or claims, including reasonable legal costs, payable to a third party because of your breach of these Terms, your breach of any law or of a third party's rights, or your use of the Services.

Section 19 - Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law and the rest will be treated as severed, without affecting the validity of the remaining provisions.

Section 20 - Waiver and entire agreement

If we do not exercise or enforce a right under these Terms, that is not a waiver of it. These Terms and any policies we post on this site are the entire agreement between you and us about the Services, and replace any earlier agreements or versions of these Terms.

Section 21 - Assignment

You may not transfer or assign your rights or obligations under these Terms without our prior written consent. We may transfer or assign these Terms and our rights and obligations without your consent.

Section 22 - Governing law

These Terms are governed by the laws of New South Wales, Australia. You and Pawd submit to the non-exclusive jurisdiction of the courts of New South Wales.

Section 23 - Changes to these Terms

You can read the current version of these Terms at any time on this page. We may update, change or replace any part of them by posting the changes on our website, and it is your responsibility to check for changes. Your continued use of the Services after changes are posted means you accept them.
